William Kirtley razgovara s privremenim mjerama zabrane prodaje imovine tijekom arbitražnog postupka s BBC News.
Intervjuirao BBC News (BBC Mundo) u vezi s planiranom prodajom američke imovine Petróleos de Venezuela S.A., William Kirtley discussed the possibility of prohibiting the the sale of State-owned assets through interim measures issued by arbitral tribunals or through domestic courts.
Arbitral tribunals have the power to prevent the sale of assets to preserve the status quo pending resolution of the outcome of the dispute under most modern international arbitration rules. Državni sudovi također imaju ovlast izdavati privremene mjere u korist arbitraže, which are similar in nature and often overlap with the arbitral tribunal’s own power in this respect.
Arbitri će odrediti privremene mjere, which are intended to preserve the status quo pending the outcome of the dispute, u slučaju vjerojatne štete jednoj strani. To je često zato što će prijenos imovine otežati provođenje eventualne arbitražne presude, stavljanje imovine izvan dosega ovršnog postupka.
