Para a maioria dos contratos internacionais, As cláusulas de arbitragem modelo elaboradas pelas instituições arbitrais são suficientes para garantir um processo arbitral flexível e com bom funcionamento no caso de surgimento de uma disputa. As cláusulas de arbitragem do modelo foram usadas em milhares de arbitragens e são testadas em batalha, fornecendo uma redação altamente improvável de criar problemas jurisdicionais. Para remover uma disputa comercial de um sistema judicial nacional e submetê-la à arbitragem no caso de uma disputa surgir, tudo o que geralmente é necessário é copiar e colar uma cláusula de arbitragem modelo em um contrato internacional.
No passado, era necessário inserir regras de arbitragem rápidas nos contratos, a fim de garantir procedimentos de arbitragem simplificados para disputas menores. A situação mudou na última década, Contudo, tantas grandes instituições arbitrais, como o TPI, SCC, SIAC, HKIAC e ICDR, integraram procedimentos de arbitragem acelerada de opt-out em suas regras de arbitragem, proporcionando automaticamente processos de arbitragem simplificados para disputas menores. Por exemplo, as disposições de procedimentos expedidos da ICC se aplicam automaticamente a disputas em que (1) o acordo de arbitragem foi acordado após 1 marcha 2017, (2) o valor em disputa é USD 2,000,000 ou menos e (3) as partes não optaram pelas Regras de Procedimento Expedido da ICC.

Associação Americana de Arbitragem (AAA) / Centro Internacional para Resolução de Disputas (ICDR)
O ICDR é a subdivisão da AAA que administra disputas internacionais. Para arbitragem ICDR, a cláusula de modelo lê:
“Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be determined by arbitration administered by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules.”
Instituto de Arbitragem da Câmara de Comércio de Estocolmo (SCC)
“Any dispute, controversy or claim arising out of or in connection with this contract, or the breach, termination or invalidity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce.”
Centro Australiano de Arbitragem Comercial Internacional (ACICA)
“Any dispute, controversy or claim arising out of, relating to or in connection with this contract, including any question regarding its existence, validity or termination, shall be resolved by arbitration in accordance with the ACICA Arbitration Rules.”
Comissão de Arbitragem de Pequim (BAC)
“All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.”
Centro Regional do Cairo para Arbitragem Comercial Internacional (CRCICA)
Cláusula Compromissória de Arbitragem:
