Pour la plupart des contrats internationaux, les clauses types d'arbitrage rédigées par les institutions d'arbitrage sont suffisantes pour garantir le bon fonctionnement et la flexibilité de la procédure arbitrale en cas de litige. Des clauses types d'arbitrage ont été utilisées dans des milliers d'arbitrages et sont testées au combat, fournir un libellé très peu susceptible de créer des problèmes de compétence. Afin de supprimer un litige commercial d'un système judiciaire national et de le soumettre à l'arbitrage en cas de litige, il suffit généralement de copier et coller un modèle de clause compromissoire dans un contrat international.
Autrefois, il était nécessaire d'insérer des règles d'arbitrage accélérées dans les contrats afin d'assurer une procédure d'arbitrage rationalisée pour les petits litiges. La situation a changé au cours de la dernière décennie, toutefois, autant de grandes institutions d'arbitrage, comme la CPI, CSC, SIAC, HKIAC et ICDR, ont intégré la procédure d'arbitrage accélérée opt-out dans leurs règles d'arbitrage, prévoyant automatiquement une procédure d'arbitrage rationalisée pour les petits litiges. Par exemple, les dispositions de la procédure accélérée de la CCI s’appliquent automatiquement aux différends (1) la convention d'arbitrage a été convenue après 1 Mars 2017, (2) le montant en litige est USD 2,000,000 ou moins et (3) les parties n'ont pas renoncé aux Règles de procédure accélérée de la CPI.

Association américaine d'arbitrage (AAA) / Centre international de règlement des différends (ICDR)
L'ICDR est la subdivision de l'AAA qui gère les différends internationaux. Pour l'arbitrage ICDR, la clause modèle lit:
